This Privacy Policy explains what information Ops Monitor, LLC ("Ops Monitor," "we," "us," or "our") collects, how we use it, and the choices you have. It covers our website at opsmonitor.ai and our analytics platform (the "Platform").
The short version
- Your data is yours. We use it for one thing, showing you your own numbers, and we don't sell it.
- We share it sparingly. Only with the providers that run the Platform (hosting, payments, e-signature), and only as described below.
- Carrier operating data runs through official, authorized channels. We don't scrape confidential carrier systems.
- Sensitive carrier data is automatically deleted after 30 days.
- If you are a paying customer, your contract with us (the Master Subscription Agreement, or "MSA") governs our relationship, and it controls if anything here conflicts with it.
1. Who this policy applies to
This policy applies to visitors to our website, people who request a demo, our customers and their authorized users, and individuals whose information appears in the operating data our customers bring to the Platform. Our customers are independent service providers ("ISPs") running delivery operations. For those customers, the MSA and the applicable Order Form set the contractual terms; this policy describes our data practices but does not change the MSA.
2. Information we collect
Information you give us
When you request a demo or contact us, we collect the information you choose to provide, which may include your name, business email, company or entity name, your role, the number of stations you run, your payroll provider, and any notes you add about your operation. When you become a customer, we collect the account and contact information needed to set up and administer your account.
Payment information
Customer payments are processed by our third-party payment processor, Stripe. When you enroll a payment method, you provide your card or bank details directly to Stripe through its hosted flow. We do not collect or store full payment card numbers or full bank account numbers on our own systems. We receive limited information from Stripe, such as a confirmation, the payment method type, and the last digits, so we can administer billing. Stripe's handling of your payment information is governed by Stripe's own privacy policy.
Operating data you bring to the Platform
The core of the Platform is the operating data our customers authorize us to access on their behalf through official, authorized carrier channels, together with data customers upload or connect from other systems they choose to use. This operating data can include information about a customer's routes, stops, settlements, drivers, and deliveries. Some of that data may identify individuals, such as a customer's drivers or the recipients of packages, and may include names, contact details, addresses, and location information.
We access and use this data only to provide the Platform's analytics to the specific customer whose data it is, and for that customer's benefit. We do not use one customer's data for the benefit of any other customer, and we do not sell it. Sensitive carrier-sourced data is subject to the 30-day deletion rule described in Section 5.
Information we collect automatically
When you use the website or the Platform, we and our service providers automatically collect technical information such as your IP address, browser and device type, pages viewed, referring pages, and timestamps, through cookies and similar technologies and through server logs. Our website also loads web fonts, which may involve a request to a third-party font provider. We use this information to operate, secure, and improve the site and the Platform, and to understand how they are used.
3. How we use information
- To provide, operate, secure, and improve the website and the Platform.
- To respond to demo requests and inquiries, and to communicate with you about your account, billing, support, and service changes.
- To produce the analytics and reports that are the purpose of the Platform, for the customer whose data it is.
- To process payments and administer billing through Stripe.
- To detect, investigate, and prevent fraud, security incidents, and misuse, and to enforce our agreements.
- To comply with our legal obligations and the obligations we owe under our authorized carrier data arrangements.
- To create de-identified and aggregated data as described in Section 4.
4. De-identified and aggregated data
We may create and use de-identified and aggregated data, meaning data from which information that identifies a customer or an individual has been removed, for purposes such as benchmarking, research, product improvement, and industry reporting. We do not attempt to re-identify this data, and we use it only in ways that do not identify a customer or an individual. Our use of de-identified and aggregated data derived from carrier-sourced data also remains subject to our obligations under our authorized carrier data arrangements.
5. How long we keep information, and the 30-day rule for sensitive carrier data
Sensitive carrier-sourced data is automatically deleted after 30 days. We automatically delete sensitive carrier-sourced data older than thirty (30) days from the Platform. As a result, historical analytics that depend on that sensitive data are limited to a rolling thirty-day window. We may keep summary or derived figures longer only where they do not include sensitive, stop-level detail.
For other information, we keep it for as long as we need it for the purposes described in this policy, to administer your account, to comply with our legal and contractual obligations, to resolve disputes, and to enforce our agreements. We keep demo-request information for a reasonable period to follow up and for our records. After your customer relationship with us ends, you have thirty (30) days to export your data, after which we may delete it, and sensitive carrier-sourced data is purged on the schedule above regardless of any export period.
6. How we share information
We do not sell your personal information. We share information only as described here.
Service providers
We use a small number of service providers to run our business, including Amazon Web Services (cloud hosting), Stripe (payment processing), and PandaDoc (electronic signature and contracting). These providers may process information on our behalf to provide their services, under agreements that require them to protect it and to use it only for the services they provide to us. Carrier-sourced data is hosted with Amazon Web Services and is not shared with other service providers.
Authorized carrier channel
Where we access operating data through an authorized carrier channel on a customer's behalf, the carrier may ask us to identify the users who access carrier-sourced data through the Platform, and we may provide their names and contact information to it for that purpose.
Legal, safety, and compliance
We may disclose information if we believe in good faith that disclosure is required by law, regulation, legal process, or governmental request, or is necessary to protect the rights, property, or safety of Ops Monitor, our customers, or others, or to enforce our agreements.
Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, information may be transferred as part of that transaction, subject to this policy.
7. Our role, and information about drivers and recipients
Much of the individual-level information in the operating data, such as information about a customer's drivers or about package recipients, is controlled by the customer who brings that data, and in some cases is owned by the carrier network the customer operates within. For that data, we act as a service provider or processor on the customer's behalf, and we handle it under the customer's instructions and our authorized carrier data arrangements. If you are a driver, a recipient, or another individual and you have a question or request about data that appears in a customer's account, please contact that customer directly, or contact us and we will route your request appropriately.
8. Security
We use reasonable administrative, technical, and organizational measures designed to protect information, including hosting with Amazon Web Services and encrypting data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your information, we will notify you and the relevant parties as required by applicable law and by our obligations. You are responsible for keeping your account credentials confidential and for promptly telling us if you believe your account or data has been compromised.
9. Your choices and rights
You can ask us to access, correct, update, or delete personal information we hold about you, and you can opt out of marketing emails by following the unsubscribe link or by contacting us. We will respond consistent with applicable law. Some data is subject to the 30-day deletion rule or to retention required for legal, billing, or contractual reasons, and some individual-level data is controlled by our customers as described in Section 7, in which case we may need to direct your request to the relevant customer.
Depending on where you live, you may have additional rights under state privacy laws, such as the right to know what personal information is collected, to request access or deletion, to correct inaccurate information, and to be free from discrimination for exercising your rights. To the extent these laws apply to us, we honor them. We do not sell personal information. If we begin sharing information for cross-context behavioral advertising, we will say so in this policy and provide the choices the law requires, as described in Section 10. To make a request, use the contact details below. We will verify your request before acting on it, and you may use an authorized agent where the law allows.
10. Cookies and advertising
We and our service providers use cookies and similar technologies to operate the Site, remember your preferences, measure usage, improve performance, and protect the Site from spam and misuse. We may also use analytics and advertising technologies, including cookies and pixels from third-party analytics and advertising partners, to understand how the Site is used and to reach people who may be interested in Ops Monitor. If we enable advertising that involves sharing information for cross-context behavioral advertising, we will update this policy and provide the opt-out choices required by applicable law. You can control cookies through your browser settings and through any opt-out tools we make available, and blocking some cookies may affect how the Site works. We do not use driver information, package-recipient information, or carrier-sourced operating data for advertising.
11. Children
The website and the Platform are for business use and are not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
12. Where we operate
We are based in the United States, and we process and store information in the United States. The website and the Platform are intended for use by businesses operating in the United States.
13. Changes to this policy
We may update this policy from time to time. When we do, we will change the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the website or the Platform after an update means you accept the updated policy.
